IMPORTANT

These Terms of Use govern your access to and use of the Altair Real Estate Services website at altairre.com and any related resident services. By accessing our website or using our resident services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

 

01  OVERVIEW & AGREEMENT

 

 

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“Resident,” “User,” or “you”) and Altair Holdings, LLC, doing business as Altair Real Estate Services (“Altair,” “we,” “us,” or “our”), with respect to your use of our website at altairre.com and any affiliated resident-facing digital tools and services (collectively, the “Services”).

Altair may update, modify, or replace these Terms at any time. We will post updated Terms on this page and provide notice of significant changes where practicable. Material changes will be communicated via notice on our website or through your resident portal. Your continued use of the Services after any changes are published constitutes your acceptance of the revised Terms.

These Terms should be read together with our Privacy Policy (available at altairre.com/privacy-policy), which is incorporated by reference and governs how we collect and handle your personal information.

 

02  LEASE SUPREMACY — YOUR LEASE CONTROLS

 

 

LEASE SUPREMACY — IMPORTANT

In the event of any conflict between these Terms of Use and your executed lease agreement with the property owner or managing agent, the terms of your lease agreement shall control. These Terms of Use govern your use of the Altair website and digital tools only and do not modify, limit, or supersede any right or obligation established in your lease.

 

These Terms of Use apply to your use of Altair’s website and digital services. They do not govern the landlord-tenant relationship, which is exclusively governed by your signed lease agreement and its addenda. Nothing in these Terms creates, modifies, waives, or extinguishes any right or obligation set forth in your lease.

Where these Terms reference resident obligations (such as payment, maintenance requests, or communications), those references are for general informational purposes only. The specific terms, deadlines, fees, and procedures that apply to you are those stated in your executed lease agreement.

 

03  ENTRATA PLATFORM & THIRD-PARTY SERVICES

 

 

Altair uses Entrata, Inc. (“Entrata”) as its primary property management platform to deliver resident services including the ResidentPortal, online rent payments, maintenance request tracking, and lease management tools.

 

ENTRATA PLATFORM NOTICE

When you access and use the Entrata ResidentPortal or any Entrata-powered services, you are also subject to Entrata’s Terms of Use and Privacy Policy (available at entrata.com). Entrata operates independently and maintains its own terms governing your account, payment processing, and data practices. Altair is not responsible for the operation, content, or availability of Entrata’s systems.

 

By creating a resident account or using Entrata-powered features, you agree to Entrata’s applicable terms in addition to these Terms. Disputes arising from your use of Entrata’s platform are governed by Entrata’s own terms and dispute resolution process, not by these Terms.

Altair may also integrate or link to other third-party tools or websites for convenience. Altair does not endorse, control, or assume responsibility for third-party websites, and your use of them is governed by their own terms and policies.

 

04  ELECTRONIC COMMUNICATIONS & NOTICES

 

 

By using our Services, you consent to receive general communications about your account and our services electronically, including via email and through the resident portal. This includes payment confirmations, maintenance status updates, and general service announcements.

IMPORTANT — FORMAL LEASE NOTICES

Formal notices required under your lease agreement — such as notices to vacate, breach notices, rent demands, or any other notice with legal significance under Pennsylvania law — must be delivered in accordance with the notice provisions of your lease, not solely by email or through the portal. The method and timing requirements in your lease govern those notices. Please consult your lease for the specific notice requirements that apply to you.

 

You are responsible for maintaining a current and accurate email address with Altair and Entrata. You may update your contact information at any time through your resident portal or by contacting our team directly.

You understand that electronically signed documents and agreements carry the same legal effect as documents with ink signatures, to the extent permitted by applicable law. However, this does not affect any requirement in your lease for written notice to be delivered in a specific form or manner.

Payment obligations and related fees, late charges, and payment methods are governed by your executed lease agreement. Online and ACH payment options are offered for convenience; their availability does not modify the payment terms or deadlines set forth in your lease.

 

05  ACCESS CREDENTIALS & ACCOUNT SECURITY

 

 

To access resident-facing services, you will create a username and password (“Access Credentials”) through the Entrata ResidentPortal or another designated system. You are solely responsible for:

        Maintaining the confidentiality of your Access Credentials

        All activity conducted under your account, whether authorized by you or not

        Notifying Altair and Entrata promptly if you believe your credentials have been compromised

 

You agree not to share your Access Credentials with any other person. If you suspect unauthorized access, please contact Entrata support and notify us at info@altairre.com immediately.

 

06  PERMITTED USE & RESTRICTIONS

 

 

Altair grants you a limited, non-exclusive, non-transferable, revocable license to access and use our website and resident services solely for lawful purposes in connection with your tenancy or prospective tenancy at an Altair-managed property. Your lease agreement governs the permitted use of your rental unit; these Terms govern your use of Altair’s digital tools only.

You may not use the Services to:

        Violate any applicable local, state, or federal laws or regulations

        Engage in unauthorized commercial activity or solicitation

        Interfere with or disrupt the operation of the website or its servers

        Attempt to gain unauthorized access to any system, account, or data

        Copy, reproduce, or create derivative works from any website content without express written consent

        Use automated tools, bots, scrapers, or similar technology to access or extract data from our Services

 

Portal access for subtenants or permitted occupants is subject to the terms of the applicable sublease and any written consent required by the property owner or managing agent. Altair reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for violations of these Terms.

 

07  RESIDENT SUBMISSIONS

 

 

Our Services may allow you to submit content such as maintenance requests, feedback, comments, or other communications (“Submissions”). By submitting content, you represent that it is truthful, accurate, and does not violate any third-party rights.

You retain ownership of your Submissions but grant Altair a non-exclusive, royalty-free license to use, store, and display your Submissions as reasonably necessary to operate the Services, fulfill your requests, or comply with legal obligations.

Altair is not responsible for the accuracy or completeness of Submissions made by other users. We reserve the right, but not the obligation, to review, edit, or remove Submissions that we determine, in our sole discretion, violate these Terms or are otherwise objectionable.

 

08  PROHIBITED CONDUCT

 

 

You agree not to submit or transmit content or engage in conduct that is:

        Defamatory, harassing, threatening, abusive, hateful, or discriminatory

        Fraudulent, misleading, or deceptive

        Infringing on any third party’s intellectual property, privacy, or other rights

        Obscene, pornographic, or otherwise inappropriate for a professional platform

        Intended to introduce viruses, malware, or harmful code into our systems

        In violation of any fair housing, consumer protection, or other applicable law

 

Violations may result in immediate termination of your portal access and may be reported to law enforcement or other relevant authorities where required.

 

09  INTELLECTUAL PROPERTY

 

 

All content on altairre.com, including but not limited to text, graphics, logos, and design elements, is the property of Altair Holdings, LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

The Altair name, logo, and all related marks are trademarks of Altair Holdings, LLC. You may not use these marks without our prior written consent. Nothing in these Terms grants you any right or license to use our intellectual property beyond what is expressly permitted herein.

Entrata’s name, ResidentPortal logo, and related marks are the property of Entrata, Inc. Your use of the Entrata platform is subject to Entrata’s intellectual property terms.

 

10  PRIVACY & DATA

 

 

Your privacy matters to us. The collection, use, and protection of your personal information is governed by our Privacy Policy (altairre.com/privacy-policy), which is incorporated into these Terms by reference. Please review it carefully.

In summary, Altair collects personal information necessary to manage your tenancy, process communications, respond to maintenance requests, and comply with legal obligations. We use Entrata and other service providers to facilitate these functions, and those providers process data in accordance with their own privacy policies.

 

DATA REQUESTS

For information stored in the Entrata platform, you may submit a Data Subject Access Request (DSAR) directly through the ResidentPortal. For all other data we hold, contact our privacy team at info@altairre.com. We do not sell your personal information to third parties.

 

We use IP addresses and cookies to analyze website traffic, improve our services, and maintain security. You may manage cookie preferences through your browser settings, though certain functionality may be affected.

 

11  CHILDREN

 

 

Our Services are intended for adults 18 years of age and older. We do not knowingly solicit or collect personal information from minors under the age of 14. If you are under 18, please have a parent or legal guardian access or manage any resident account or services on your behalf.

If we learn that we have inadvertently collected personal information from a child under 14 without verifiable parental consent, we will promptly delete that information. Contact us at info@altairre.com if you believe we may have information from a minor.

 

12  ALTAIR’S ROLE AS MANAGING AGENT

 

 

Altair Real Estate Services acts as managing agent and, in some cases, broker on behalf of property owners. Altair does not own the residential or commercial properties it manages. The landlord-tenant relationship exists between you (the tenant) and the property owner; Altair facilitates management services on the property owner’s behalf.

Altair’s liability in connection with lease matters is limited to its role as managing agent. The property owner’s liability, and Altair’s liability as agent, are as set forth in your executed lease agreement. Nothing in these Terms creates personal liability for Altair beyond its role as managing agent.

Broker commissions and any related claims arising from lease transactions are governed solely by the terms of applicable lease agreements, not by these Terms.

 

13  FORCE MAJEURE

 

 

Altair’s website and digital services may be temporarily unavailable due to circumstances outside our reasonable control, including acts of God, natural disasters, government orders, pandemics, cyberattacks, utility outages, strikes, or other force majeure events. Such unavailability does not constitute a breach of these Terms and does not give rise to liability on Altair’s part.

LEASE OBLIGATIONS UNAFFECTED

The unavailability of Altair’s website or the Entrata portal does not excuse, delay, or modify any obligation under your lease agreement, including the obligation to pay rent on time. Please contact your property management office directly if online services are unavailable and you need to fulfill a lease obligation.

 

14  DISCLAIMERS OF WARRANTY

 

 

ALTAIR PROVIDES THIS WEBSITE AND THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALTAIR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION, AVAILABILITY, ACCURACY, OR RELIABILITY OF THE SERVICES. ALTAIR EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

 

Altair is not responsible for the availability, accuracy, or content of third-party websites or platforms, including Entrata’s ResidentPortal. Your use of those platforms is at your own risk and subject to their respective terms.

Nothing in this disclaimer limits or modifies Landlord’s repair and maintenance obligations under your lease, which are governed exclusively by the lease agreement.

 

15  LIMITATION OF LIABILITY

 

 

TO THE FULLEST EXTENT PERMITTED BY LAW, ALTAIR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ALTAIR’S TOTAL LIABILITY TO YOU FOR CLAIMS RELATED TO THESE TERMS OR THE WEBSITE AND PORTAL SERVICES EXCEED THE AMOUNTS PAID BY YOU TO ALTAIR IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

 

This limitation applies solely to claims arising from your use of Altair’s website and digital services. Claims arising from your lease agreement — including security deposit disputes, damage claims, and eviction proceedings — are governed by your lease and applicable Pennsylvania law, not by these Terms.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, Altair’s liability will be limited to the greatest extent permitted by applicable law.

 

16  INDEMNIFICATION

 

 

You agree to defend, indemnify, and hold harmless Altair Holdings, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

        Your use of or access to the Services

        Your violation of these Terms

        Any inaccurate or incomplete information you provide to Altair or Entrata in connection with website or portal use

        Your infringement of any third-party rights through use of the Services

 

Your indemnification obligations under your lease agreement, including but not limited to obligations arising from damage to the rental unit, holdover, or breach of lease covenants, are governed by your lease agreement, not by this section.

 

17  DISPUTE RESOLUTION

 

 

LEASE DISPUTES — NOT COVERED HERE

Disputes arising from your lease agreement — including rent, security deposits, eviction, maintenance, or any other landlord-tenant matter — are governed by your lease and applicable Pennsylvania law. The dispute resolution provisions in this section apply only to disputes about your use of Altair’s website and digital services.

 

We encourage you to contact us first to resolve any website or portal-related concerns informally at info@altairre.com.

Any dispute that cannot be resolved informally and that arises solely from your use of Altair’s website or digital services (not from a lease agreement) may be submitted to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”), conducted in Erie County, Pennsylvania. The arbitrator’s decision shall be final and binding and may be entered as a judgment in a court of competent jurisdiction.

You agree that any such claim must be brought within one (1) year after the cause of action arose, or it shall be permanently barred. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect its rights.

 

18  MODIFICATIONS TO TERMS

 

 

Altair reserves the right to modify these Terms at any time. We will post updated Terms on this page and, where appropriate, notify you via email or a notice in the resident portal. The “Effective Date” at the top of this page indicates when these Terms were last updated.

Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Services. Modifications to these Terms do not modify your lease agreement.

 

19  GOVERNING LAW & VENUE

 

 

These Terms and any disputes arising from your use of Altair’s website and digital services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of law. Subject to the arbitration provisions in Section 17, you consent to the exclusive jurisdiction of the state and federal courts located in Erie County, Pennsylvania for the resolution of any disputes not subject to arbitration.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
